Terms of Service

1. Agreement and operator

These Terms of Service ("Terms") govern your use of AI Tattoos, an online tattoo design workspace available at aitattoos.art (the "Service"). AI Tattoos is operated by the owner of the AI Tattoos brand and domain. In these Terms, "AI Tattoos", "we", and "us" mean the Service operator; "you" means the person using the Service or the organisation they represent.

By creating an account, purchasing a plan, or continuing to use the Service, you agree to these Terms and the Privacy Policy. You must be at least 18 years old, or the age of majority where you live. If you do not agree, do not use the Service.

2. The Service and AI model dependency

AI Tattoos is a digital software service that helps you explore tattoo concepts, generate tattoo artwork, convert images to tattoo styles, create lettering and stencils, explore cover-up ideas, and preview designs. Features, styles, limits, and pricing are shown in the Service and may change as the product develops.

Generation uses third-party infrastructure and AI model providers, including the LinoRoute gateway and the model selected for the current generation mode. Provider availability, safety filters, latency, and model behaviour can affect a result. We may change or replace a provider when reasonably necessary to operate or improve the Service.

3. Accounts, guest workspaces, and security

You can try the Service without signing in. A new guest workspace receives the free allowance displayed in the product (currently four credits). Guest workspaces are tied to an essential browser session and can be restored with a recovery key if you create one. Free credits and guest workspaces are for one person and cannot be sold, transferred, or combined to create extra allowances.

An account can be created with a verified email address and password. Keep your password, recovery key, and email account secure. You are responsible for activity carried out through your account and must contact support promptly if you suspect unauthorised access. Do not share credentials or use another person's account without permission.

4. Plans, credits, and generation charges

The Service may offer a free tier and paid Pro and Ultra plans in monthly and yearly billing intervals. The current plan names, prices, credit allowances, and generation costs are shown on the Pricing page and at checkout. A generation reserves the displayed credit cost. If a job fails before a usable result is delivered, we may return the eligible credits to the same allowance period.

Plan credits are usage rights for the Service, not cash or a bank balance. Monthly allowances refresh at the start of the next allowance period and unused included credits do not roll over unless the product expressly says otherwise. Credits cannot be redeemed for cash, transferred to another account, or used outside AI Tattoos. We may adjust credit costs or allowances with reasonable notice when model or infrastructure costs change.

5. Billing and automatic renewal

When you choose a paid plan and provide a payment method, you expressly authorise AI Tattoos to charge the displayed amount for the selected billing interval through Waffo Pancake. A monthly plan renews each month and a yearly plan renews each year until you cancel. A yearly plan is charged once for the year; the included allowance is made available according to the plan description. Applicable taxes may be added or collected at checkout.

The checkout page and receipt identify the merchant and transaction details. We do not store complete payment card numbers on our server. Waffo Pancake processes the payment transaction and may provide us with payment status, order references, billing email, and limited transaction information needed to deliver the plan.

6. Cancellation

You can cancel automatic renewal from your signed-in workspace by opening Account, choosing the active plan, and selecting Cancel renewal. You can also send a cancellation request from the email on your account to support@aitattoos.art. Cancellation stops the next renewal; the paid plan remains available until the end of the current paid period unless the product or applicable law says otherwise.

If you have more than one paid workspace under the same account, cancel renewal in each workspace before requesting account deletion. A canceled subscription does not automatically refund unused credits.

7. Refunds and billing corrections

Digital access and credits are delivered when payment is confirmed, so used credits and used subscription periods are generally non-refundable. A first-time paid subscriber may request a full refund within seven days of the first charge if they have used no more than ten percent of the credits available for the current period. This policy does not limit any non-waivable consumer or statutory refund right.

We also review requests for duplicate charges, an incorrectly billed amount, or a verified Service outage caused by us that lasts more than 72 consecutive hours. Send the account email, Waffo transaction or order ID, and a short explanation to support@aitattoos.art. We aim to acknowledge a request within two business days and process an approved refund through the original payment method. Refunds may revoke remaining credits granted by the refunded transaction.

8. Your inputs and generated outputs

You keep the rights you already have in prompts, text, photographs, reference images, and other material you submit ("Input"). You give AI Tattoos a limited, non-exclusive licence to host, process, resize, transmit, and display the Input only as needed to provide, secure, troubleshoot, and support the Service. We do not use your private Input to train a general-purpose AI model without your separate permission.

Subject to these Terms and applicable law, you may use an output created from your Input ("Output") for your personal or commercial design work. AI outputs may be similar to other outputs, may contain errors, and may include elements that are not protected by copyright. You are responsible for checking the Output and obtaining any rights or permissions needed before publishing, selling, or tattooing it.

9. Tattoo safety and professional review

AI Tattoos provides visual concepts, not medical, legal, or professional advice. An Output is not a final tattoo stencil, sterilisation instruction, diagnosis, or guarantee that a design is safe for a particular person or body area. Review spelling, symbolism, cultural references, placement, size, contrast, and skin suitability with a qualified tattoo artist before using a design. Follow your artist's aftercare and safety instructions.

10. Acceptable use

You may use the Service only for lawful purposes and in a way that does not harm other people, the Service, or our providers. You must not:

• Upload or generate content that is unlawful, defamatory, threatening, harassing, hateful, fraudulent, or intended to deceive.
• Create sexual content involving a minor, exploitative content, non-consensual intimate imagery, or content that meaningfully impersonates a real person to mislead others.
• Infringe copyright, trademark, privacy, publicity, or other rights, or upload another person's private image without the required permission.
• Use the Service to create malware, phishing material, instructions for wrongdoing, or content that facilitates violence or abuse.
• Bypass rate limits, safety systems, authentication, credit controls, or other security features; scrape outputs at scale; or resell access without written permission.
• Use Inputs, Outputs, or model responses to train, fine-tune, benchmark, distil, or build a competing machine-learning service without our written permission.

11. Third-party services

The Service depends on third-party providers for hosting, email delivery, AI generation, and payment processing. Their own terms and privacy policies may apply to the part of the service they provide. We are not responsible for a third party's independent outage, policy, or data practice, but we will take reasonable steps to keep the Service working and to address provider incidents.

12. Suspension and termination

We may limit, suspend, or terminate access if you materially breach these Terms, create a security or legal risk, abuse credits, submit prohibited content, or fail to pay an amount due. Where practical, we will explain the reason and give you a chance to resolve it. If we discontinue a paid Service for reasons unrelated to your breach, we will provide a reasonable remedy for the unused portion of a prepaid period where required by law.

13. Disclaimers and liability limits

The Service is provided on an “as available” basis. To the maximum extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and the accuracy or uniqueness of AI Outputs. We do not promise that every prompt will produce a usable result or that the Service will be available at every moment.

To the maximum extent allowed by law, AI Tattoos will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability for a claim relating to the Service is limited to the amount you paid to AI Tattoos for the Service during the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited.

14. Disputes and governing law

Before starting a formal claim, please email support@aitattoos.art with the account email, order details, and the issue so we can try to resolve it. These Terms are governed by the laws applicable to the Service operator's principal place of business, subject to any mandatory consumer protections that apply where you live. You and AI Tattoos agree to use a court or dispute forum that has lawful jurisdiction over the claim.

15. Changes and general terms

We may update these Terms when the Service, law, or payment arrangements change. For a material change, we will update the date above and, where we have a usable account email, provide reasonable notice before the change takes effect. Continued use after the effective date means you accept the updated Terms. If one provision is unenforceable, the remaining provisions continue. These Terms, the Privacy Policy, and the checkout details form the agreement between you and AI Tattoos for the Service.
